Terms of Service

In short. Half up front, half before launch, then a required monthly maintenance fee set by what you had built. The domain is free and is held by us while that plan runs; after twelve months of payments it transfers to you at no charge, or sooner for a $25 release fee. Your content and data are yours from day one. No contract — cancel maintenance with 30 days’ notice. Anything that changes the agreed scope is quoted separately before it is built.

01Who these terms are between

These terms govern work carried out by Infinitence, registered in Malaysia under SSM number 202603200080 (IP0629814-V) ("we", "us"), for the client engaging us ("you").

They apply from the moment you accept a quotation or pay a deposit, whichever happens first.

02Quotations and scope

Before any work begins you receive a written quotation setting out the deliverable, the fixed price, the number of revision rounds and an estimated timeline. Prices shown on this website are published in US dollars and are indicative ranges; your quotation is the binding figure.

A quotation is valid for 30 days. Anything not written in it is not included.

Invoices are payable within 14 days. We do not begin work before the deposit clears, and we do not launch or hand over before the balance clears.

Bank charges, currency conversion fees and payment-processor fees are yours.

Maintenance is billed monthly in advance from the launch date. Prepay six months for 10% off, or twelve months for two months free. Prepaid periods are not refundable on early cancellation, but the service runs to the end of the period paid for.

04Revision rounds

Each package includes a set number of revision rounds, stated in your quotation and on the pricing page.

A revision round means one consolidated set of feedback, sent together, covering changes within the agreed scope — wording, imagery, colour, spacing, ordering. Feedback sent piecemeal over several days counts as separate rounds. Additional rounds beyond those included are quoted before they are carried out.

05Changes to agreed scope

New pages, new features, a different structure, or a change of direction after design sign-off are not revisions — they are additional scope. We will tell you so, quote for it in writing, and only build it once you approve.

We will not silently absorb scope creep, and we will not silently bill you for it.

06What we need from you

  • Text, images, logos and any brand assets, in usable quality.
  • Access to domain, hosting, social or system accounts where the build requires it.
  • One named decision-maker who can approve work.
  • Feedback within a reasonable time at each stage.

You confirm you own or are licensed to use everything you supply. We use placeholder content while building; if final content does not arrive, the build launches with placeholders or waits, at your choice.

07Delays and dormant projects

Timelines assume feedback and content arrive when agreed. Delays on your side move the delivery date accordingly.

If a project goes without response from you for 30 days, we may treat it as dormant, invoice for the work completed to that point, and release the reserved build time. Restarting a dormant project is subject to availability and may be re-quoted.

08Ownership and intellectual property

Yours from day one. All content you supply or we produce for you — text, images, product data, customer records and enquiry history — belongs to you. We will export the lot in a usable format whenever you ask, at no charge, whether or not you are still a client.

Held by us while the plan runs. The domain, hosting, SSL, CDN and AI provider accounts are registered to and paid for by Infinitence, and remain Infinitence assets for as long as your maintenance plan is active. That is what allows the domain to be included free and billed as one monthly fee instead of four separate invoices.

How you take the domain. After 12 months of paid maintenance, the domain transfers into your name at no charge, on written request. Before that point you may still take it on payment of a $25 release fee, which covers the registration we paid for on your behalf. We will not refuse a transfer request that meets these terms, and we will not raise the fee after the fact.

If maintenance lapses. If payment stops, we will give you 14 days’ written notice before the site is taken offline, and we will hold the domain without re-selling or re-pointing it for 60 days from that notice so you have time to transfer it or resume the plan.

The build itself. Ownership of the delivered code, designs and layouts we produced for you transfers to you on receipt of the final build invoice, independently of the hosting arrangement. A copy of the site files is provided on request.

We retain the right to describe the work and show it in our portfolio unless you ask us in writing not to. Any third-party frameworks, libraries or fonts used remain under their own licences.

09Third-party services and costs

Domain, hosting, SSL and AI provider usage are paid for by us and covered by your maintenance fee. You will not receive separate invoices for them and you will not be charged extra if provider prices rise within a period you have already paid for.

Fair use applies to AI provider credits. If conversation volume runs materially above the plan — we will show you the figures — we will agree a revised fee with you in writing before anything changes. We will not silently bill you for it and we will not throttle your bot without telling you.

Payment gateways, POS, accounting and CRM subscriptions stay on your own accounts. We connect to them; we do not resell them. We are not responsible for outages or pricing changes on services we do not operate.

10Maintenance (required)

Every build includes a maintenance plan. It is not optional: it is what keeps the domain renewed, the site online, the backups running, the software patched and your prices current. The fee is a flat monthly figure set by what was built — $39 for a landing page up to $189 for e-commerce or anything with AI — and is published on the pricing page.

No contract. There is no minimum term. Cancel at any time with 30 days’ written notice. Prepay six months for 10% off, or twelve months for two months free.

The plan covers the domain, hosting, SSL, CDN, security updates, daily backups, uptime monitoring, content edits (prices, promotions, photos, hours), AI provider credits with conversation review where applicable, and priority WhatsApp support.

It does not cover new pages, new features or redesigns. Those are quoted in writing before they are built. Unused edit time does not roll over.

On cancellation, clause 08 governs what happens to the domain and your content.

11Corrections and warranty

For 30 days after launch we fix, free of charge, anything that does not work as specified in your quotation — broken links, forms that fail, layout faults on current browsers.

This does not cover new features, content changes, third-party service failures, or problems caused by edits made by you or another party after handover.

12Cancellation

You may cancel in writing at any time. The deposit covers work reserved and already carried out and is non-refundable. If work completed at the point of cancellation exceeds the deposit, we invoice the difference; if it is less, no further payment is due.

We may cancel and refund any amount not yet worked against if a project falls outside what we can deliver responsibly.

13Liability

We build carefully and test what we deliver, but no website, chatbot or automation is guaranteed to be uninterrupted or error-free. AI systems can produce incorrect output; where a build involves one, you are responsible for reviewing how it is used in your business.

Our total liability for any claim is limited to the amount you have paid us for the work concerned. We are not liable for indirect or consequential loss, including lost profits or lost data.

14Governing law

These terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction over any dispute. Where a client is based elsewhere, this does not remove consumer rights that apply in their own country and cannot be contracted out of.
